These Terms of Service ("Terms") govern your engagement with MarketCreativeLab, Jakoberstr. 14, 86152 Augsburg, Germany ("Provider", "we", "us"). By engaging our services, you agree to be bound by these Terms.
1. Scope of Services
MarketCreativeLab provides creative advertising, marketing strategy, brand development, content production, and related consulting services. The specific scope, deliverables, timeline, and pricing for each engagement are defined in a separate project proposal or Statement of Work ("SOW") agreed upon by both parties.
2. Project Proposals & Amendments
Each project begins with a written proposal outlining scope, milestones, deliverables, and pricing. Any changes to scope requested by the client may result in amended timelines and pricing, which will be documented in a written change order before work proceeds.
3. Payment Terms
Payment terms are specified in each project proposal. Standard terms require a 50% deposit upon project commencement, with the remaining balance due upon delivery or at agreed milestones. Late payments incur a statutory interest rate per ยง 288 BGB. All prices are quoted in EUR and are exclusive of applicable VAT.
4. Intellectual Property
Upon full payment, all final deliverables and associated intellectual property rights are transferred to the client. MarketCreativeLab retains the right to display completed work in portfolios and case studies unless otherwise agreed in writing. Pre-existing tools, frameworks, and methodologies used in service delivery remain the property of MarketCreativeLab.
5. Confidentiality
Both parties agree to maintain the confidentiality of proprietary information shared during the engagement. This obligation survives termination of the agreement for a period of two years.
6. Limitation of Liability
MarketCreativeLab's total liability shall not exceed the total fees paid by the client for the specific project giving rise to the claim. We are not liable for indirect, incidental, or consequential damages, including lost profits or business interruption.
7. Termination
Either party may terminate the agreement with 14 days' written notice. In the event of termination, the client is responsible for payment of all work completed up to the termination date. Completed deliverables are released upon receipt of payment.
8. Governing Law
These Terms are governed by the laws of the Federal Republic of Germany. The place of jurisdiction for any disputes is Augsburg, Germany.
This Refund and Reimbursement Policy applies to all services provided by MarketCreativeLab, Jakoberstr. 14, 86152 Augsburg, Germany.
1. Deposit
The initial deposit (typically 50% of the total project fee) is non-refundable once work has commenced. This deposit secures your project slot and covers initial strategy development, research, and resource allocation.
2. Milestone-Based Payments
For projects with milestone-based payment structures, each payment becomes non-refundable once the corresponding milestone deliverables have been delivered and accepted by the client.
3. Client-Initiated Cancellation
If the client cancels a project before any work has commenced (within 48 hours of deposit payment), a full refund of the deposit will be issued. Cancellations after work has begun will be subject to a prorated refund based on work completed at the time of cancellation, minus the non-refundable deposit.
4. Provider-Initiated Cancellation
If MarketCreativeLab initiates cancellation for any reason, a full refund of all payments received will be issued within 14 business days.
5. Dissatisfaction
If you are dissatisfied with completed deliverables, please notify us in writing within 14 days of delivery. We will review the matter and, at our discretion, either revise the deliverables at no additional cost or issue a partial refund proportionate to the scope of the dissatisfaction.
6. Processed Payments
Approved refunds will be processed within 14 business days to the original payment method. Refund processing times may vary depending on your financial institution.
